Our terms and conditions below govern your use of our website. We will supply you with any goods (“Goods”) listed on our website www.customballoonsco.au
Please tick the box at the checkout process if you accept them. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Goods from our website.

1. APPLICATION OF TERMS
- 1.1 These terms and conditions apply to all sales of Goods provided by us to you via our website, over the telephone, by email or in person.
- 1.2 No contract for the supply of Goods (the “Contract”) shall exist until we dispatch the Goods to you.
- 1.3 Each order for Goods by you to us will be deemed to be an offer by you to purchase Goods subject to these terms.
- 1.4 You must ensure that the terms of your order and any applicable specification are complete and accurate.
- 1.5 These terms will be incorporated in the Contract to the exclusion of all other terms and conditions.
2. DESCRIPTION OF GOODS
- 2.0 The Goods will conform in all material respects with any specification provided to and accepted by us. We reserve the right to amend any specification without prior notice to you provided that any such amendment does not adversely affect the performance of the Goods.
3. WEBSITE ACCESS
- 3.0 It is not necessary to register with us in order to use most parts of this website.
- 3.1 This website may be used for your own private purposes and in accordance with these terms and conditions.
- 3.2 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.
4. PRICE
- 4.1 The price of any Goods will be as quoted on our website or as otherwise agreed between us, except in cases of obvious error.
- 4.2 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already been dispatched.

5. PAYMENT
- 5.1 Payment for goods can be made by cards, using paypal or bank transfer in exceptional instances.
6. DELIVERY
- 6.1 The Goods will be delivered to the delivery address provided by you
- 6.2 We will use all reasonable endeavours to avoid late deliveries.
7. WEBSITE
- 7.1 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.
- 7.2 Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.
- 7.3 When using this website you shall not post or send to or from this website any material:
- (a) for which you have not obtained all necessary consents;
- (b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in Ireland.

- 10.1 These terms and conditions are governed by Australian Law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction in Australian courts.
11. RETURNS POLICY
- 11.0 We very rarely have balloons damaged in transit as they are all individually and carefully wrapped. If an item arrives damaged give us a call or drop us an email and we will send out a replacement balloon ASAP. If you are dissatisfied with your order for any reason, please call or drop an email and we will refund or exchange. If you wish to cancel an order that has not been dispatched, please call or drop an email and we will refund. Please allow up to 14 days for a refund.
